Facts
Nantucket, Inc. was based in North Carolina and manufactured men’s shirts with the term “Nantucket” on them. Nantucket, Inc. filed an application to register the term NANTUCKET. The United States Patent and Trademark Office denied the application. The Trademark Trial and Appeal Board (Board) affirmed the denial on the grounds that the mark was “primarily geographically deceptively misdescriptive” because Nantucket was a geographic place and Nantucket, Inc.’s shirts were not made in Nantucket. Nantucket, Inc. appealed.
