Facts
In two cases, the family court found that homelessness was the primary obstacle preventing foster children from reuniting with their families. In both cases, the court ordered the state’s Department for Children and Their Families (department) (defendant) to provide financial support to help the families get housing and reunite. The department petitioned the Rhode Island Supreme Court for review of the orders. The department argued that it was not a housing agency and that forcing it to pay for families’ housing costs would divert money from its primary mission of helping families reunite. The supreme court agreed to review the issue.
