Facts
Orva O’Neil wrote her daughter Tess a letter stating that [Tess’s son] “John and [his] family are welcome to live as long as they wish” in the house in Garden City. When Orva passed away, the house was sold. John sued the estate, claiming that he and his family had a life estate in the house. The surrogate court held that the letter did not grant John a life estate.
