In re Ohio Execution Protocol Litigation
United States Court of Appeals for the Sixth Circuit
845 F.3d 231 (2016)
- Written by Rose VanHofwegen, JD
Facts
Ohio death-row inmates (plaintiffs) sued Ohio officials involved in the execution process, as well as anonymous drug manufacturers, compounders, and intermediaries involved in supplying lethal injection drugs. After a hearing, the district court entered a protective order preventing disclosure of information that could identify the manufacturers or suppliers. The inmates asked the court to modify the order to allow limited disclosure only to counsel designated “attorney’s eyes only,” but the court refused. The inmates appealed.
