Facts
The New Hampshire legislature amended RSA 490:1, providing that, upon the retirement of Chief Justice Brock, the New Hampshire supreme court justice with the most seniority would be administratively appointed as the new chief justice for up to five years. Governor Craig Benson and the New Hampshire Executive Council requested an advisory opinion from the New Hampshire Supreme Court determining whether RSA 490:1 violated the separation-of-powers provisions of the New Hampshire Constitution.
