Facts
Pysz (debtor) was sued for failing to pay for professional services. The claimant in that action (creditor) obtained a judgment and judicial lien against Pysz. The creditor’s judicial lien applied to logging equipment and real property owned by Pysz. The creditor properly recorded the lien. Less than 90 days later, Pysz filed for chapter 13 bankruptcy. The trustee filed a motion for summary judgment seeking to avoid the creditor’s judicial lien as a preference under 11 U.S.C. § 547(b).
