Quadrillion Publishing Limited (plaintiff) applied to register the trademark “BRAMLEY.” The trademark examiner found 433 surname entries for Bramley in PHONEDISC POWERFINDER USA, a surname database. The examiner also found that there was no entry for Bramley in Webster’s and other unabridged dictionaries commonly used in the United States. Quadrillion presented evidence of a small village in England called Bramley and of an entry for Bramley in the Oxford English Dictionary. The trademark examiner rejected the application on the ground that Bramley was primarily a surname. Quadrillion appealed.
