Facts
A petition was filed in juvenile court alleging Randolph T. (defendant), a juvenile, had committed delinquent acts. Following a hearing on June 9, 1980, the juvenile court, applying a preponderance of the evidence standard, waived jurisdiction and ordered that Randolph should be tried in criminal proceedings. At the time of the hearing, Randolph was awaiting trial on an unrelated murder charge. Randolph then appealed the juvenile court order and the Court of Special Appeals affirmed. The Court of Appeals of Maryland later granted certiorari to review the case.
