Facts
The United States government received a request from the United Kingdom, pursuant to that country’s mutual-legal-assistance treaty (MLAT) with the United States, to assist in obtaining privately held recorded tapes pertaining to a British murder case. The attorney general granted the request and appointed a commissioner (plaintiff) to retrieve the tapes from Boston College (BC) (defendant). BC refused to release the tapes. The commissioner petitioned a federal district court to subpoena the tapes. The district court granted the commissioner’s petition and denied BC’s motion to quash the subpoena. BC appealed to the First Circuit. One of the issues raised on appeal was the government’s contention that the district court had no authority to quash MLAT-related subpoenas.
