Facts
A proposed class of HIV-positive hemophiliacs (plaintiffs) brought a class-action negligence suit against four manufacturers of blood solids (defendants), based on state law. The class comprised thousands of people who resided across the country. The district court certified the class and proposed instructing the jury on negligence by combining the various state negligence standards into a single rule. The manufacturers requested a writ of mandamus vacating the class certification on the ground that the district court’s proposed jury instructions were improper.
