Facts
Robert M. (defendant) was nine years and 10 months old when he was charged with delinquency for bank robbery. The defense argued that Robert was merely playing a joke, that he could not and did not have a culpable mental state because of his age, and that the court should hold that the presumption of infancy applied to delinquency cases.
