In re S.M.
Illinois Appellate Court
416 N.E.2d 1212 (1981)

- Written by Rich Walter, JD
Facts
The State of Illinois (plaintiff) prosecuted S.M. (defendant), a minor, for shooting four boys, killing two and wounding two others. The trial jury convicted S.M. for voluntary manslaughter, aggravated assault, and unlawful use of a gun. After the trial court adjudged S.M. delinquent and committed S.M. to a juvenile corrections facility, S.M. appealed to the Illinois Appellate Court. The appellate court found that the trial record established that S.M. shot his initial victim in justifiable self-defense and that S.M. shot his subsequent victims in quick succession.
