Facts
Darla Serassio (defendant) was a City Justice Court judge in Utah, where gambling was illegal. In late 2006, Serassio engaged in online gambling activities at her Utah home, during her personal time and on her personal computer. Serassio also used the court’s fax machine twice during 2006 and 2007 to claim money that she had won during her at-home gambling activities. A complaint was filed against Serassio with the Utah Judicial Conduct Commission (the commission) based on Serassio’s gambling. Serassio responded to the complaint and admitted to having engaged in internet gambling from her own home on her own time. Serassio also resigned from her judgeship effective July 3, 2007. Following a confidential hearing, the commission issued a decision regarding whether to reprimand Serassio for her conduct.
