Facts
Police detectives knew that 10-year-old SH (defendant), a boy of below-average intelligence, had lied to them about the circumstances surrounding six-year-old BR’s death. SH’s father was present when the detectives brought SH to the police station for questioning. The police told the father to go home. A detective took SH into an interrogation room, gave SH the standard Miranda warnings, explained those warnings, and obtained SH’s waiver of his Miranda rights. Ninety minutes later, the detective emerged with SH’s confession to having pushed BR into a canal. The state (plaintiff) charged SH with second-degree murder and introduced SH’s confession at his trial in juvenile court. SH was found guilty and sent to a juvenile incarceration facility. SH appealed to the New Jersey Supreme Court.
