In re Sinnreich
United States Court of Appeals for the Eleventh Circuit
391 F.3d 1295 (2004)
- Written by Sara Rhee, JD
Facts
Simon Sinnreich (defendant) declared bankruptcy. Under Florida law, all property interests of a debtor are included in the debtor’s bankruptcy estate. Sinnreich argued that property he owned with his wife as tenants by the entirety should be exempt from the bankruptcy estate under § 522 of the United States Bankruptcy Code. One of Sinnreich’s creditors, Frank Musolino, objected. The bankruptcy court denied the objection and the district court affirmed the decision.
