In re South African Apartheid Litigation
United States Judicial Panel on Multidistrict Litigation
238 F. Supp. 2d 1379 (2002)

- Written by Catherine Cotovsky, JD
Facts
Current and former residents of South Africa (residents) (plaintiffs) sued numerous financial and corporate entities (corporations) (defendants), demanding reparations for injuries they suffered as a result of crimes related to apartheid in South Africa. Residents brought their claims in three separate actions, two of which were filed in the Southern District of New York and one in the District of New Jersey. Residents then filed a motion with the Judicial Panel on Multidistrict Litigation to request that the action pending in New Jersey be transferred to the Southern District of New York and that all three actions be consolidated for pretrial. Some of the corporations supported centralizing the matters in one court, but others asserted their opposition.
