Facts
Stand ‘N Seal Spray-On Grout Sealer was a household product used to seal ceramic tile grout. After the product’s formula was changed to include the use of Flexipel (a fluoropolymer chemical), seven of the product’s users (users) (plaintiffs) sued the manufacturer (defendant) for strict products liability, breach of warranty, and negligence, alleging that exposure to the reformulated product caused respiratory problems. Each of the users had purchased the product on different dates and each complained of different injuries. The manufacturer moved to sever the claims of each user or, alternatively, to order a separate trial for each user.
