Anonymous Publicly Traded Company (APTC) (plaintiff) sought to learn the identities of Internet-service subscribers of America Online (AOL) (defendant), and APTC issued a subpoena to AOL requesting this information. APTC wanted the identities of AOL’s subscribers in order to correctly name the subscribers as defendants in another action. AOL asserted that its subscribers’ First Amendment rights to anonymity prevented APTC from obtaining the subscribers’ identities. AOL submitted a Motion to Quash APTC’s subpoena.
