In re Ta Chi Navigation Corp.
United States Court of Appeals for the Second Circuit
677 F.2d 225, 1982 AMC 1710 (1982)
- Written by Carolyn Strutton, JD
Facts
Ta Chi Navigation Corp. (defendant) owned a large cargo ship, the Eurypylus. The ship and most of its cargo were destroyed when the ship caught fire at sea en route from Japan to Panama. The fire began with a spark from an acetylene torch and quickly spread out of control when canisters of oxygen and acetylene, which were stored in an alleyway near the engine room, exploded. Owners of the destroyed cargo (the cargo owners) (plaintiffs) sued Ta Chi Navigation for the damages to their cargo, alleging that Ta Chi Navigation had been negligent in storing the canisters in the alleyway. The district court ruled for the cargo owners, holding that the storage of the canisters had rendered the Eurypylus unseaworthy at the start of the voyage. Ta Chi Navigation appealed.
