Facts

Miami held an election for executive mayor on November 4, 1997, resulting in an outcome so close that a run-off election occurred on November 13. On November 4, candidate Suarez led in absentee votes and candidate Carollo led in machine votes. In that run-off election, candidate Suarez won over candidate Carollo. Thereafter, the trial court heard candidate Carollo's protest to the run-off election outcome. On March 3, 1998, the trial court ruled that the absentee ballots evidenced substantial fraud. Statistical evidence buttressed this ruling. The trial court invalidated the election results on this basis, and the Florida District Court of Appeal heard this appeal.
