Facts
TPT Transportation (TPT) (plaintiff) engaged the services of HBM River Plant, Inc. (HBM) to clean a barge belonging to TPT so it could pass Coast Guard inspection and take on new cargo. During the cleaning, there was an explosion that injured four of HBM’s employees. TPT filed suit to seek limitation of its liability to the injured workers. The workers’ claims were settled, and TPT filed an indemnity claim against HBM to recover TPT’s attorney fees incurred in defending the personal-injury claims and for the sums TPT paid in settlement. TPT maintained that it committed no negligence in the explosion. HBM moved for summary judgment.
