Facts
Paulette Turner (defendant) was 13 years old when she was raped. Afterwards, Turner began defying her mother, staying out all night, and having sexual relationships with boys. Turner’s mother reported Turner to a state agency (plaintiff), which filed a complaint in juvenile court, alleging that Turner was delinquent. The court found that Turner was delinquent and released her on probation into her father’s custody. A few months later, Turner and convicted criminal Carl Swoveland participated in a sham wedding ceremony in the presence of Turner’s parents. Swoveland was serving his term in prison when Turner became pregnant through a relationship with a different man. When Turner gave birth, the state immediately took custody of the newborn and filed a complaint alleging that the newborn was a dependent child. At trial, Turner argued that the newborn could not be found to be dependent because Turner never had custody or control of the newborn.
