Facts
Julia Voorhis executed a will that created multiple trusts, including one for the purpose of placing monuments and markers on her family’s burial plot in a specified cemetery. Voorhis was related to General William Clark, one of the leaders of the famous Lewis and Clark expedition, and her family plot had a substantial, expensive monument to Clark on it. Initially, money from the trust was spent on insurance to repair or replace Clark’s monument in case of damage. However, a court was asked to determine the continuing validity of this trust.
