In re Wyant
United States Bankruptcy Court for the District of Nebraska
217 B.R. 585 (1998)
- Written by Abby Roughton, JD
Facts
Martin Wyant (debtor) filed for chapter 13 bankruptcy and submitted a proposed chapter 13 plan for confirmation by the bankruptcy court. The plan did not propose payment of Wyant’s disposable income to the chapter 13 trustee as required by 11 U.S.C. § 1325(b). Instead, the plan proposed significant expenditures for the feeding and veterinary care of Wyant’s many elderly horses and dogs. The bankruptcy court considered whether to confirm the plan.
