Facts
Robert C. Yacavino (defendant) was admitted to the bar in 1974. In 1980 Yacavino entered private practice, and in 1981 he began working for a law firm. The law firm took over the practice of a retiring attorney in Pompton Plains, New Jersey, and assigned Yacavino to work out of that office. For a year, Yacavino worked alone with virtually no supervision. The firm’s partners rarely visited the Pompton Plains office. During that time, Yacavino began working on an adoption matter for a client who was previously represented by the retired attorney. Yacavino failed to take action on the adoption matter and created fake orders to make the client believe that he was working on the matter. Although Yacavino did not take these actions for purposes of self-enrichment, charges were brought against Yacavino for violating disciplinary rules, and the Disciplinary Review Board (board) (plaintiff) recommended that Yacavino be suspended from legal practice.
