Facts
B.B. (defendant) was placed on formal probation with the Department of Juvenile Court Services (JCS) after receiving multiple juvenile court referrals for various offenses. At a dispositional hearing in February 1993 for a new offense, the juvenile court found B.B. had violated his probation contract multiple times. JCS recommended B.B. be placed in group foster care (a group home), but none were available due to a statutorily imposed limit on these placements. The juvenile court concluded that the least-restrictive available placement was at the state training school and transferred B.B. for placement there. B.B. was later transferred back to the custody of his mother but was subsequently found to have violated multiple terms of a behavioral contract executed when he returned to his mother’s care. The juvenile court then recommitted B.B. to the state training school but noted that he should be placed in highly structured group foster care when an opening became available. B.B. subsequently appealed the dispositional order.
