Facts
C.P. was six years old and R.D. was nine years old (defendants) when they were charged in juvenile court with aggravated sexual assault after they allegedly pinned down six-year-old E.Z. and stuck their fingers in her vagina. A pretrial evaluation of R.D. was conducted and found that he was developmentally delayed and lacked knowledge of most sexual facts. A psychiatric evaluation of R.D. concurred with the pretrial assessment and found that he was emotionally immature with below-average intellectual functioning. An assessment with similar results was also conducted on C.P. Both C.P. and R.D. filed motions to dismiss the complaints against them.
