Facts
ABC Fulfillment Services LLC and Indubitably, Inc. (collectively, d.b.a. HobbyKing) (defendant) sold audiovisual transmitters for model airplanes and drones. Several devices for sale on HobbyKing’s website operated in illegal frequency bands or at illegal power levels in violation of the Communications Act of 1934. The Enforcement Bureau (the Bureau) of the Federal Communications Commission (FCC) (plaintiff) investigated HobbyKing and issued citations and a letter of inquiry requesting additional information. HobbyKing did not respond to the letter of inquiry, and the FCC issued a notice of apparent liability proposing a forfeiture against HobbyKing of approximately $2.8 million.
