Facts
Ingrid A. and Mona A. (plaintiff) were legally married in the Netherlands. Wanting a child, the couple decided that Mona’s ova would be fertilized in vitro by a sperm donor and then implanted in Ingrid’s uterus. The procedure was successful, and Ingrid gave birth to their child. The birth certificate listed Ingrid as the sole parent. Ingrid and Mona began to raise the child together. Mona filed a petition for adoption, notwithstanding New York’s recognition of their marriage, citing the need to ensure that her parental rights would be respected in other jurisdictions. There was no dispute between the parties.
