Facts
Birach Broadcasting Corporation (Birach) (defendant) applied to renew its broadcast licenses for two radio stations it operated. Both stations had been left silent for extended periods of time. When the stations were not silent, they were operated at abnormally low power. As a result, the Federal Communications Commission (FCC) (plaintiff) set the renewal applications for an expedited hearing.
