Facts
Christopher K. (defendant) was charged in a delinquency action in children’s court. Christopher requested a jury trial and then moved to withdraw the request. The state opposed Christopher’s motion. The trial court held that the state had the right to demand a jury trial and set the matter for trial by jury. Christopher filed an interlocutory appeal. On appeal, the state (plaintiff) argued that the New Mexico Bill of Rights and statute granted it the right to demand a jury in juvenile proceedings.
