Facts
In December 1990, 14-year-old D.S. (defendant) was adjudicated delinquent for murder and sentenced to 30-years commitment to the Texas Youth Commission. Pursuant to state law, the juvenile court later held a release-or-transfer hearing to determine whether D.S. should be released from confinement or transferred to the Institutional Division of the Texas Department of Criminal Justice (TDCJ). Following the hearing, the juvenile court ordered D.S. transferred to TDCJ. D.S. appealed the juvenile court’s order, arguing that there were multiple constitutional errors in his release-or-transfer hearing.
