Facts
Frank H. (defendant) appeared for an initial intake conference before New York Family Court without an attorney. The judge in family court assigned Frank H. counsel when Frank H. made his first appearance before the judge. Through his assigned attorney, Frank H. made a motion to vacate the petition and to send the case back to intake. In his motion, Frank H. argued the court should consider de novo whether Frank H.’s Sixth Amendment rights were violated when he appeared at the initial intake appearance. The family court judge made a ruling on the motion.
