Facts
Howard Sleeper, Hayden Gaylor, and Elaine Gaylor (the applicants) (defendants) bought the properties of two farmers in order to construct an artificial lake as part of a ski resort. The lands had been devoted to agricultural purposes for more than a century prior to their sale. The applicants submitted an application to transfer water rights to the New Mexico state engineer in order to change the properties’ irrigation use and places of diversion. The state engineer approved the transfer application. The Ensenada Land and Water Association and other local irrigators (plaintiffs) appealed the application approval to the district court.
