Facts
Oregon Revised Statutes § 33.460 allowed individuals to legally change their sex if they attested that they underwent treatment for the purpose of affirming their gender identity—that is, an individual’s internal sense of being male, female, or neither entirely male nor entirely female. Pursuant to § 33.460, Jones David Hollister (plaintiff) filed an application to change their legal sex from female to nonbinary, meaning someone who identified as neither entirely male nor entirely female. Hollister attested that they underwent treatment for the purpose of affirming their nonbinary gender identity. The trial court denied Hollister’s application, finding that § 33.460 did not permit them to legally change their sex to nonbinary. Hollister appealed.
