Facts
Attorney James Lisher employed Heather Brant as an office assistant for 17 years. Lisher gave Brant broad authority over most office tasks, including banking and communicating with clients. Over the course of several months in the last year of her employment, Brant embezzled thousands from the firm’s operating account, overdrew the client trust account, and created several fraudulent legal documents including fake court orders. Lisher’s failure to appropriately maintain complete trust-account records or supervise Brant significantly enabled her actions. Lisher repaid the clients affected, but the Indiana Supreme Court Disciplinary Commission initiated disciplinary proceedings for violating the Indiana Rules of Professional Conduct. Lisher cooperated with the process and agreed to a “Statement of Circumstances and Conditional Agreement for Discipline” stipulating that he had violated the rules and proposing a 60-day suspension with automatic reinstatement.
