Facts
A Republican Congress passed, and President Bill Clinton signed into law, the Telecommunications Act of 1996 (TA of 1996) to preserve the vibrant and competitive free market that existed for the Internet. In a 2015 order, the Federal Communications Commission (FCC) reclassified broadband Internet access as a telecommunications service subject to regulatory obligations under Title II of the Communications Act of 1934, as amended (the act). This reclassification of Internet access effectively abandoned almost 20 years of precedent under the TA of 1996, which prohibited the federal and state governments from regulating the Internet.
