Facts
SBC Communications, Inc. (SBC) (defendant) was being investigated by the Federal Communications Commission (FCC) (plaintiff) for possible discriminatory actions in violation of the Communications Act of 1934. The FCC’s Enforcement Bureau (the Bureau) sent questions to SBC through a letter of inquiry. SBC sent its answers, and the Bureau ordered SBC to provide sworn verification as to the truth and accuracy of its answers. SBC refused to provide the verification, and the Bureau issued a notice of liability against SBC for a forfeiture penalty of $100,000. SBC appealed.
