Facts
Action and Protection Foundation (APF) and its chairman, Daniel Bodnar (plaintiffs) were interested parties in Hungarian civil and criminal proceedings aimed at hate speech against Hungarian Jews posted on the website Kuruc.info. Bodnar and APF filed an application seeking discovery for use in the Hungarian proceedings from Bela Varga (defendant), the California resident who registered Kuruc.info’s domain name, and Cloudflare, Kuruc.info’s webhost (defendant). The documents sought included all bank records for Varga’s account and electronically stored information regarding Kuruc.info. Bodnar asserted that Kuruc.info did not identify its blog authors, two criminal investigations were pending in Hungary, two cases had been suspended because the offender could not be identified, and Bodnar could not proceed with his civil defamation action because he could not identify the offender. The subpoenas were narrowed at the application hearing. Neither Varga nor Cloudflare appeared.
