Facts
The City of Jackson (plaintiff) filed a petition in chancery court to annex 24.25 square miles of unincorporated territory. The city’s population was decreasing, and there were already significant chunks of vacant land within the city’s boundaries. Evidence indicated that the current municipal services in the annexation area were adequate. Some witnesses testified to a concern that quality of such services would decrease with the annexation. Multiple witnesses testified that the city needed the tax revenue that residents of the annexation area would provide. The chancery court granted the city’s petition. Those objecting to the petition appealed.
