Inbesa America, Inc. v. M/V Anglia
United States Court of Appeals for the Eleventh Circuit
134 F.3d 1035 (1998)

- Written by Alex Ruskell, JD
Facts
Inbesa America, Inc. (Inbesa) (plaintiff) entered into a contract to perform certain services for M/V Anglia (defendant). These services included dockage, stevedoring, unloading cargo from trucks, stuffing and stripping containers, securing cargo without containers, and moving cargo through Inbesa’s wharf. When the Anglia failed to pay its bills, Inbesa sued in federal court based on admiralty jurisdiction. The court ruled in favor of Inbesa, and the Anglia appealed. Specifically, the Anglia argued that the majority of the contract contained nonmaritime obligations that were done on land, such as unloading trucks and moving cargo through the wharf, and thus that the federal court would not have jurisdiction over the claim.
