Industrial Commission of Wisconsin v. McCartin
United States Supreme Court
330 U.S. 622, 67 S. Ct. 886, 91 L. Ed.1140, 169 A.L.R. 1179 (1947)

- Written by Mary Phelan D'Isa, JD
Facts
Kopp, an employee, and McCartin, Kopp’s employer, were both Illinois residents. While working for McCartin in Wisconsin, Kopp was injured on the job. Kopp sought workers’-compensation benefits in both Illinois and Wisconsin. Illinois issued its decision first, which specifically noted that it did not impact Kopp’s rights to compensation under the Wisconsin workers’-compensation laws. Thereafter, the Wisconsin workers’-compensation commission gave Kopp an additional award. On appeal and citing Magnolia Petroleum Co. v. Hunt, 320 U.S. 430 (1943), the Wisconsin commission set aside the additional award.
