Facts
Information Resources, Inc. (plaintiff) voluntarily submitted privileged material to the government, thinking that the government might use the information to engage in an enforcement action against Information Resources’ competitors (defendants). Subsequently, Information Resources sued its competitors in a civil action. The competitors sought access to the privileged information that Information Resources had submitted to the government. Information Resources argued that the materials were privileged.
