Facts
International Business Machines Corp. (IBM) (plaintiff) filed petition for a writ of mandamus, requesting to be released from the trial judge’s (defendant) requirement that all interviews of adverse witnesses be conducted with either opposing counsel or a stenographer present, so that the transcript would be available for the court to see. The trial judge issued this ruling after the Government, the plaintiff in the underlying case, refused to allow IBM to interview two of its witnesses. Because the order proved to be difficult to implement, IBM requested the writ of mandamus.
