Facts
Vermont enacted a law requiring genetically modified milk and milk products to be labelled as such. The International Dairy Foods Association (plaintiff) sued, arguing that the Food and Drug Administration did not require such labelling and that requiring disclosure on a product’s labeling violated the association’s First Amendment rights. Vermont defended itself by stating the law was based on strong consumer interest and the public’s right to know. The district court ruled in Vermont’s favor, and the association appealed.
