Facts
The Bicycle Thief, an Italian film, was originally published in 1948. International Film Exchange, Ltd. (IFEX) (plaintiff) and Corinth Films, Inc. (Corinth) each claimed exclusive rights to distribute The Bicycle Thief in the United States pursuant to Italian license agreements. IFEX sued Corinth for copyright infringement, alleging that Corinth had infringed on IFEX’s exclusive distribution rights. When IFEX filed its infringement action, The Bicycle Thief was still protected under Italian copyright laws and was expected to remain protected for a period of at least 70 additional years. Both Corinth and IFEX moved for summary judgment.
