Facts
George Izraelewitz (plaintiff) bought electronic diagrams from Don Britton Enterprises (Don Britton) for $290. Izraelewitz used his credit card issued by Manufacturers Hanover Trust Company (the bank) (defendant). Don Britton had a strict no-refund policy with respect to its designs. According to Don Britton, the policy was in place because its printing business was only a small part of its overall business and because it was selling original designs. The policy was clearly shown in the Don Britton catalog with the instructions on how to order. Izraelewitz was not satisfied with the designs from Don Britton and sent them back. Because of Don Britton’s no-refund policy, Don Britton did not credit Izraelewitz any money. Izraelewitz sued the bank seeking reimbursement for the $290.
