Facts
J. Crew International (J. Crew) (plaintiff) was an American corporation that sold clothing. It owned two American trademarks: “J. Crew” for clothing and catalog services and “Crew” for clothing. Telepathy, Inc. (defendant) owned multiple domain names, including crew.com and jcrew.com, that bore similarities to J. Crew’s trademarks. However, none of Telepathy’s domain names were used as active websites. Upon learning of these websites, J. Crew offered Telepathy to join its affiliate network, whereby Telepathy would host ad links to J. Crew’s official websites on Telepathy’s domain names. Later, J. Crew offered to buy the domain names from Telepathy, but Telepathy declined. J. Crew then revoked Telepathy’s membership in the affiliate network.
