J.F. Parkinson Co. v. Building Trades Council of Santa Clara County
California Supreme Court
154 Cal. 581 (1908)
- Written by Sarah Hoffman, JD
Facts
The Building Trades Council of Santa Clara County (the council) (defendant) was an association of labor unions that adopted a rule that union employees would not work alongside nonunion coworkers or supply any business that employed nonunion workers. After J.F. Parkinson Company (Parkinson) (plaintiff) refused to fire a nonunion worker, all union workers quit and contractors with union employees stopped supplying Parkinson. Parkinson brought a claim against the council, and the lower court enjoined the council from coercing others not to do business with Parkinson. The council appealed.
