J.R.J. Enterprises, Inc v. M/V Duncan Island

United States District Court for the Southern District of New York
2012 WL 1450421 (2012)

  • Written by Tanya Munson, JD

Facts

J.R.J. Enterprises, Inc. (J.R.J.) (plaintiff) was a fruit importer and sought to ship mangoes from Ecuador to New York. J.R.J. entered into a contract with South Pacific Shipping Co. Ltd. (South Pacific) and Ecuadorian Line, Inc. (Ecuadorian) (defendants) to ship the mangoes on board the vessel the M/V Duncan Island. South Pacific issued a bill of lading that specified that mangoes were to be shipped in a sealed, refrigerated container. The container was loaded on board the M/V Duncan Island on November 13, 2009, and arrived in New York on November 22, 2009. When J.R.J received the container, some of the mangoes were marked with black and brown spots. On September 1, 2010, J.R.J. filed a complaint alleging a maritime claim. J.R.J. alleged that South Pacific and Ecuadorian were negligent in properly maintaining the temperature of the shipment of mangoes at all times until receipt of the cargo. South Pacific and Ecuadorian filed a motion for summary judgment.
